Unless otherwise noted, the Site and its original content, features and functionality are owned by CPM. and are protected by international copyright, trademark, patent, trade secret and other intellectual property or proprietary rights laws. All other trademarks, service marks, trade names, trade dress, product names and logos are the property of their respective owners.

Reasonable Use

CPM's subscription products are intended for individual self-study and exam preparation and are sold in the form of subscriptions. The products are designed to facilitate careful review by users of all content contained within the subscriptions in order to deliver maximum benefit and optimal study experience to our typical users (hereafter also referred to as "normal" product usage). "Typical" refers to users with a usage pattern of at least 90% of regular users of any particular subscription. Normal product usage does not include usage which is suspected to be shared between multiple users. Usage of CPMs subscriptions which is determined not to fall under reasonable use may result in action taken against the account, at CPM's sole discretion. Subscription utilization that is indicative of, or arising from, impermissible business, multiple user, community, or fraudulent use may result in suspension or termination of the subscription in question. CPM may contact any user at any time to request clarification of a usage pattern which does not fall under reasonable use.

Termination

We may terminate your access to the Site, without cause or notice, which may result in the forfeiture and destruction of all information associated with you. All provisions of this Agreement that by their nature should survive termination shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

Refund Policy for Online Exams, Courses, and Downloadable Products

Since you have the ability to use these items quickly and we cannot see if these items show wear/use, we are unable to provide a refund on these items.

Cancellation Policy for Live Classes

Public training participants who cancel their registrations up to 30 days prior to the registered class will receive a full refund of the registration fees paid. If a cancellation is made within 14 days of the scheduled class, the participant will be charged a 30% cancellation fee. Cancellations made with less than 48 hours notice prior to a class start, or registered participants who do not attend the training without providing prior notice, will be not be eligible for a refund or credit and will be charged the full amount of the registration. All cancellation requests must be made via email to our Director of training, dan@capeprojectmanagement.com.

Links To Other Sites

Our Site may contain links to third-party sites that are not owned or controlled by CPM. CPM has no control over, and assumes no responsibility for, the content, privacy policies, or practices of any third party sites or services. We strongly advise you to read the terms and conditions and privacy policy of any third-party site that you visit.

Disclosure:

FTC Regulations requires that all website must disclose the use of affiliate links. CPM occasionally adds affiliate links within our content through which I earn affiliate commissions.

CPM is  a participant in the Amazon Services LLC Associates Program, ClickBank, LLC and Google Adsense which are designed to provide a means for sites to earn advertising fees by referring and advertising content.

 Professional Affiliations

CPM is not affiliated with Scrum.org, the Scrum Alliance or the Project Management Institute, other than the author of the exams has passed the PSM I, PSPO I, PSD I and PMI-ACP exams.

Governing Law

This Agreement (and any further rules, policies, or guidelines incorporated by reference) shall be governed and construed in accordance with the laws of Massachusetts, United States, without giving effect to any principles of conflicts of law.

Changes To This Agreement

We reserve the right, at our sole discretion, to modify or replace these Terms of Service by posting the updated terms on the Site. Your continued use of the Site after any such changes constitutes your acceptance of the new Terms of Service. Please review this Agreement periodically for changes. If you do not agree to any of this Agreement or any changes to this Agreement, do not use, access or continue to access the Site or discontinue any use of the Site immediately.

Privacy and Security Notice

Information submitted by you within our website, will be used only by us in order to provide customer support to you, inform you of any new promotion or update of our website, or to help process your order, in case help is needed. We do not sell or share your information with anyone else. If you purchase a product or service from us, our credit card processing vendor will request certain personally identifiable information from you on our order form. You must provide contact information such as name, email, and and financial information (such as credit card number, expiration date). We use Paypal and Stripe to process our financial transactions. They both utilize SSL encryption to transmit sensitive information. The information provided to them, will be only kept by them. CPM will not have access to it.
